“In 1871, West Virginia Supreme Court upheld the right of the legislature to unilaterally open districts within school districts,” said News9 Legal Analyst Mike Nogay.
The following year, a constitutional amendment was enacted.
“It said if you want to establish a free school or another school district in our existing school district, you have to put it to a vote of the majority of voters,” said Nogay.
