Mr. Nogay has earned a national reputation for his advocacy skills during his more than forty (40) years of practice and has recently concentrated on complex commercial litigation. Because of his litigation successes, including cases successfully tried to verdict for his corporate clients, Mr. Nogay has continually been voted a Super Lawyer, in the field of general litigation, by his peers. He has represented large banks, oil and gas companies, coal companies and an extensive group of Fortune 500 companies and other multi-national corporations from across the country. Mr. Nogay is frequently asked, by the largest law firms in the country, to serve as local and/or to co-counsel in matters pending in both state and federal courts. The law firms who have asked Mr. Nogay to co-counsel with them in complex commercial litigation include law firms from New York, Texas, California, Illinois, Minnesota, Florida, South Carolina, Louisiana, New Jersey and North Carolina. In the past several years, Mr. Nogay has successfully litigated cases in six (6) states- Florida, New Jersey, Texas, West Virginia, Ohio and Pennsylvania, including successfully trying cases to verdict in Palm Beach County, Florida, Lycoming County, Pennsylvania and the West Virginia Business Court.

Practice Areas
Mr. Nogay’s practice has included his successful representation of major banking institutions, oil and gas companies, Fortune 500 companies and other major corporations from throughout the United States in complex commercial litigation matters. Mr. Nogay has represented oil and gas companies and a financial institution in class action cases.
He has also represented multiple coal companies, energy companies, health care groups and physicians, as both plaintiffs and defendants. These diverse representations have enabled Mr. Nogay to fully understand the litigation process to best serve the interests of his clients in legal proceedings. Mr. Nogay has achieved hundreds of millions of dollars in verdicts or settlements for his clients in a multitude of jurisdictions and he has successfully won dismissal and/or counterclaims for corporate clients he has represented. Mr. Nogay’s courtroom successes for his clients have occurred in multiple federal courts and in six (6) separate state courts.
Mr. Nogay’s practice has recently concentrated on complex commercial litigation in the states Nogay, is licensed to practice law, Pennsylvania, Ohio and West Virginia, and those states which have admitted Mr. Nogay, via pro hac vice motion, including New Mexico, Florida, New Jersey and the Texas State Business Court.
Mr. Nogay’s practice in the energy sector has pivoted from representing coal companies to representing corporate clients in the oil and gas industry. Mr. Nogay has been actively litigating cases, including cases involving the contractual obligations owed under major oil and gas leases, including royalties owed thereunder, for oil and gas companies, energy companies, private equity groups. He has also litigated cases involving midstream matters. Mr. Nogay has successfully litigated cases involving oil and gas lease interpretations, including overriding royalties, royalty deductions, and a seminal decision in the oil and gas industry concerning binding arbitration clauses in leases. (See, Heller v. TriEnergy, Inc., 877 F. Supp. 2d 414 (USDC NDWV, 2012)). That federal court decision has been widely reported.
Mr. Nogay’s law practice is limited, primarily, to commercial litigation, on behalf of corporations. He has represented clients in cases in state courts throughout West Virginia, Ohio, Pennsylvania, Florida, New Jersey, Texas and New Mexico, and in federal district and appeals courts of several different jurisdictions.
Education and Bar Admissions
Mr. Nogay attended West Virginia University, where he graduated, cum laude, with a Bachelor of Science in accounting. While in college, Mr. Nogay was a member of several academic honorary societies. Mr. Nogay received his Juris Doctor from West Virginia University’s College of Law, where he was selected to The Order of Barristers, a national advocacy honorary. While in law school, Mr. Nogay was a member of West Virginia’s College of Law’s Moot Court Board and was a member of their National Moot Court Board Team.
Mr. Nogay is licensed to practice law in West Virginia, Ohio and Pennsylvania, and is admitted to practice before the Supreme Courts of those states, as well as multiple federal district and appeals courts, including the Fourth Circuit Court of Appeals. He is a member of the bar associations of West Virginia, Ohio, and Pennsylvania. Mr. Nogay has also been admitted, via pro hac vice motion, into the state courts of New Mexico, Florida, New Jersey and the Texas State Business Court.
Professional, Community and Charitable Honors
During his career, Mr. Nogay is frequently recognized for his courtroom success and excellence. Those honors include Mr. Nogay continually being voted a Super Lawyer in general litigation by his peers, and his selection for membership into the National Trial Lawyers Top 100 Lawyers, an organization that recognizes the best trial attorneys in the United States. Mr. Nogay has been accepted for lifetime membership into the elite Million Dollar Advocate’s Forum for his monetary courtroom successes for his clients. The Million Dollar Advocates Forum is comprised of the top trial lawyers in America and accepts less than 1% of all lawyers into its membership. Mr. Nogay is a Master for the William Blackstone Inns of Court, for the United States District Court for the Northern District of West Virginia. He has attained a peer-reviewed “Very High Rating in Both Legal Ability and Ethical Standards” from Martindale-Hubbell.
In addition to being asked to speak at seminars for other lawyers, Mr. Nogay has served as the Vice Chairman of the West Virginia State Bar’s Real Estate Committee, as City Solicitor for Chester, West Virginia and has served on a variety of charitable, civic, professional, and bank boards
Personal and Family Background
Mr. Nogay is married to Cathryn Samples Nogay, and they have two sons, Evan and Camden, both of whom graduated from Dartmouth. Mr. Nogay and his wife are residents of Pinehurst, North Carolina, where Mr. Nogay is a member of the Pinehurst Country Club.
